Rule (Art. 51): 21 days of basic pay per year for the first 5 years, 30 days per year after that, capped at 2 years' total pay. Minimum 1 year of service.

The rule (Decree-Law 33/2021)

- 30 days of basic pay for each year after the first 5
- Total gratuity is capped at 2 years' pay
- A minimum of 1 year of continuous service is required
